6 COMPETITION POLICY (UK)
Конкурентная политика Великобритании
Согласно законодательству о конкуренции конкурентная политика Великобритании затрагивает шесть основных сфер: а) монополии. Монополией считается рыночная ситуация, в условиях которой одна компания контролирует 40% производства продукции данной отрасли. Соответствие монополий интересам общества оценивается Комиссией по конкуренции (см. Competition Commission); б) слияния и поглощения. Объединения компаний попадают в поле зрения закона, если они создают или усугубляют монопольную ситуацию на рынке: их доля на рынке не может превышать 25%, а их активы - сумму свыше Ј70 млн. Комиссия по конкуренции может рекомендовать заблокировать процесс объединения компаний, если в результате этого произойдет ограничение конкуренции и существенно увеличится уровень концентрации рынка; в) соглашения об ограничении конкуренции. Такие соглашения запрещаются на основании Закона о конкуренции 1998 г. (см. Restrictive trade practices); г) поддержание розничных цен (см. Resale price maintenance). Как правило производители не имеют права поддерживать розничные цены на свою продукцию. Однако Закон о розничных ценах (см. Resale Prices Acts) предусматривает исключения в том случае, если производителю удается доказать, что такая мера принесет чистую экономическую выгоду; д) методы ограничения конкуренции. Любая практика ограничения конкуренции (см. Restrictive trade practices) изучается Управлением по добровольной конкуренции или Комиссией по конкуренции и может быть запрещена, если на то имеются основания; е) защита интересов потребителей (см. Consumer protection).
